If you’ve been following the never-ending push and pull between federal gun laws and personal freedoms, this one’s a breath of fresh air. The Supreme Court just dropped a unanimous ruling that’s got a lot of us in the Tactical Shit community talking. In United States v. Hemani, the justices basically said the feds can’t automatically strip someone of their Second Amendment rights just because they occasionally use marijuana.
This isn’t some blanket green light for everything — it’s narrow and focused on the facts of the case — but it’s still a solid victory for anyone who values the Constitution over one-size-fits-all prohibitions. Let’s break it down like we did on the latest Shots Fired episode.
The Case That Got Us Here
Ali Hemani, a dual U.S.-Pakistan citizen living in Texas, found himself in hot water after the FBI searched his place and turned up a legally purchased Glock along with some marijuana and a bit of cocaine. He admitted to using pot roughly every other day. Under the federal Gun Control Act (specifically §922(g)(3)), being an “unlawful user” of a controlled substance is enough to make gun ownership a felony — up to 15 years in prison.
But the Supreme Court, in a 9-0 decision written by Justice Neil Gorsuch, said nah — not like this. They ruled that applying this ban to someone like Hemani, whose use wasn’t shown to create any particular danger or incapacity, doesn’t hold up under the Second Amendment. The Court looked at historical analogues (mostly around alcohol) and decided the government’s approach here was too broad. Occasional users who aren’t demonstrably dangerous can’t just be disarmed by default.
It’s worth noting this is the same law that was used against Hunter Biden, but the ruling is tailored enough that it probably won’t rewrite the book for heavier substance issues. Still, with marijuana legal or decriminalized in so many states (and the feds even reclassifying it), this feels like the Court acknowledging reality on the ground.
Why This Matters to Gun Owners
Look, a lot of responsible adults out there enjoy marijuana in states where it’s legal, and they also own firearms for self-defense, hunting, or just because it’s their right. For years, the federal ban created this weird gray area that could turn law-abiding citizens into felons overnight. This decision chips away at that.
It doesn’t mean the law is gone entirely — the feds can still go after people whose drug use actually makes them a clear risk. But it forces them to prove relevance instead of relying on automatic disqualification. That’s a win for due process and common sense.
