A U.S federal judge in Florida ruled on Monday that Biden’s mask mandate on public transportation including airports and transit hubs is “unlawful” because it exceeded the statutory authority of the CDC and it violated the administrative law.
On Monday, U.S. District Judge Kathryn Kimball Mizelle overturned Biden’s mask mandate, claiming it unconstitutional.
“The Court concludes that the Mask Mandate exceeds the CDC’s statutory authority and violates the procedures required for agency rulemaking under the [Administrative Procedure Act],” Judge Mizelle stated in her ruling.
“The Court DECLARES UNLAWFUL and VACATES the Mask Mandate, remanding it to the CDC for further proceedings consistent with this order,” Mizelle added.
“The Court directs the Clerk to TERMINATE President Joseph R. Biden, Jr., as a Defendant to this action, to ENTER final judgment in favor of Plaintiffs as prescribed in this order, and to CLOSE this case,” Mizelle concluded.
A U.S. judge in Florida said on Monday that a mask mandate on public transportation is unlawful, overturning a Biden administration effort to reduce the spread of COVID-19.
The Transportation Security Administration and Federal Aviation Administration declined to comment. The White House and Centers for Disease Control and Prevention (CDC) did not immediately comment.
The Florida lawsuit was filed by a group called the Health Freedom Defense Fund in July 2021.
The CDC first issued a public health order requiring masks in interstate transportation in February 2021. The Transportation Security Administration (TSA) issued a security directive to enforce the CDC order.
The judge sent the issue back to the CDC. It was not immediately clear if the judge’s order would take immediate effect.
Last week, the Biden regime announced to extend the travel mask mandate for another two weeks until it is extended again. The current travel mask mandate was set to expire today, April 18.
According to the Associated Press, the Biden Regime is extending it for at least two more weeks to ‘monitor an uptick in Covid-19 cases.’
