According to Firearm Chronicles
One of the campaign promises Joe Biden made while running for office was that he would push through a new assault weapon ban. Considering the anti-gun jihad Biden has pushed in the past, this is one campaign promise we would do well to expect him to keep. Especially in light of the insane regulations proposed by Rep. Shiela Jackson Lee.
With Democrats controlling both the House and the Senate, there’s good reason to be concerned.
However, lawmakers in Montana have an idea that might help just a bit.
Montana lawmakers on Tuesday considered a measure that would prohibit local law enforcement agencies from enforcing federal bans on firearms and ammunition.
Supporters of the bill told the House Judiciary Committee that it would protect the Second Amendment from stiffer gun control laws that could be imposed by the Democrat-dominated U.S. Congress and the administration of President Joe Biden.
Bill sponsor Rep. Jedediah Hinkle, R-Belgrade, said “the time has come now to fortify Montana’s gun owners against a very likely attack on our constitutionally protected freedoms.”
The bill would ban state employees from enforcing or implementing federal bans on firearms, magazines or ammunition, except in certain cases, including those related to fully automatic firearms, violent felons, and domestic violence.
…
Hinkle and other supporters alluded to possible gun restrictions that could be reconsidered after the election of President Joe Biden — including a ban on AR-style rifles, universal background checks, restrictions on high-capacity magazines and a federal red flag law designed to prevent people at risk of harming themselves or others from purchasing a firearm. But some have said such measures face an uphill battle amid polarization of the issue.
This sounds great, but let’s also understand what it is and what it isn’t.
What it’s not is a blanket nullification of federal gun control laws, even new ones, within the state. It doesn’t mean that if you have an AR-15 that become illegal under a new gun control law, you’re exempt if you live in Montana.
Nor does it mean you can’t be arrested in the state of Montana for that same gun.
What it means is that local law enforcement wouldn’t be permitted to enforce those laws. That’s it.
Federal authorities such as the ATF could still roll into town and arrest you for having an illegal firearm or illicit magazines. You can still do a lot of time in prison despite this law potentially existing.
Now, I’m not saying I don’t think this law should pass. I actually support it and hope it’s signed into law. There’s no reason local authorities should be forced to comply with unconstitutional laws, and this bill would prevent that.
I just think it’s important to understand what the bill will do and what it won’t do. Let’s not get too excited. This isn’t really a sanctuary law in the truest sense of the world. Then again, a lot of sanctuary laws aren’t really sanctuary laws, either, so there’s that.
While this should pass, it’s also important to dig and get ready to fight Biden’s gun ban so that he never gets a chance to sign it into law.
